Trademark Registration

AUXILIARY
A trademark is a distinctive intellectual property right protecting any unique sign — word, logo, slogan, design, colour combination, or shape — that identifies and differentiates the products or services of one entity from those of others. Trademark registration confers exclusive rights to use the mark within the registered product/service classes and provides the legal standing to enforce those rights through the courts. In India, trademark registration is governed by the Trade Marks Act 1999 and administered by the Trade Marks Registry under the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM). Registration is available across 45 international trademark classes — 34 for goods and 11 for services. The TM symbol (™) may be used immediately upon filing; the ® symbol is reserved for fully registered trademarks.Trademark symbols used in commerce:™ — Identifies an unregistered trademark (application filed but not yet registered)℠ — Identifies an unregistered service mark® — Identifies a registered trademarkRegistration ProcessTrademark availability search on the CGPDTM online portalApplication filing online or in person at the Trade Marks RegistryExamination by the Registry; objections (if any) must be replied to within 30 daysPublication in the Trade Marks Journal — open for opposition for 4 monthsGrant of registration certificate (if unopposed or opposition decided in applicant's favour)Applications can be filed within 2–3 days; full registration typically takes 18–24 months.

Our Process

1
Trademark Search
We conduct a comprehensive search of the Indian Trademark Registry database to check for identical/similar existing marks in the relevant classes, reducing risk of objection or opposition.
2
Class Identification
We identify the correct Nice Classification class(es) — from 45 international classes — that cover your goods and services, ensuring comprehensive protection across your business activities.
3
Application Filing
We file the trademark application on the IP India Trademark Registry portal. Applications can be filed as individual, company, or LLP. Expedited (priority) examination is available for an additional fee.
4
Examination & Publication
The Trademark Registrar examines the application and may issue an Examination Report with objections. We respond to objections with legal arguments and precedents. Accepted marks are published in the Trademark Journal for 4 months.
5
Opposition Period
During the 4-month journal publication period, third parties can file opposition. We manage all opposition proceedings protecting your mark's registration.
6
Registration Certificate
Once the opposition period passes without challenge (or opposition is overcome), the Trademark Registration Certificate is issued. The ® symbol can now be used. Registration is valid for 10 years.

Frequently Asked Questions

A registered trademark grants you the exclusive right to use the mark in India for the registered goods/services. It enables you to legally prevent others from using identical or deceptively similar marks, seek damages for infringement, and license or franchise your brand. Without registration, your protection is limited to common law rights which are harder to enforce.

The Nice Classification is an international system of 45 classes (34 goods + 11 services) used in trademark registration worldwide. Each trademark application must specify the class(es) covering your products or services. Protection is class-specific — a trademark in Class 25 (clothing) does not protect you in Class 9 (electronics).

The total process typically takes 18–36 months: filing to examination (6–12 months), journal publication (4 months opposition window), and registration (1–3 months after opposition period). Trademark protection begins from the date of filing — the ™ symbol can be used immediately after filing.

Yes. ™ (trademark) can be used from the day of application filing. ® (registered trademark) can only be used after the Trademark Registration Certificate is issued. Using ® before registration is a legal offence in India.

No — trademark registration is class-specific. If your brand covers multiple product/service categories across different Nice Classes, separate applications are needed for each class. FGMS advises on the optimal multi-class filing strategy to protect your brand comprehensively at minimum cost.
